Michael Jackson's mother Katherine was absent while her lawyer appeared in a Los Angeles court to continue the appeal of her $1 billion negligence lawsuit against concert promoter AEG Live.
Jackson's attorney Kevin Boyle told the reporters that she was kept informed of the proceedings.
"We're the underdog, and we're not supposed to win.
But I think we should win under the facts of the law here," Boyle said.
"Katherine very much misses her son, and she very much would like to see justice done and is hoping for a favorable result.
If we are unsuccessful here, we're going to explore going to the California Supreme Court. If we need to, we will. That would be the next stop."
Jackson's appeal claims the original lawsuit's trial judge incorrectly dismissed negligence and employment claims and allowed the jury to receive a faulty verdict form.
A decision on the appeal from the 2nd District Court of Appeal is expected in the next three months.
